## Rules that shape recruitment software

- **Conduct of Employment Agencies and Employment Businesses Regulations 2003:** terms with workers and clients, and what you must confirm before introductions and assignments.
- **Agency Workers Regulations 2010:** equal treatment rights after 12 weeks in the same role, so the system must count qualifying weeks and breaks correctly. Agency workers must also receive a Key Information Document.
- **Right to work:** since 2022 employers can use an identity service provider (IDSP) for digital checks on British and Irish passport holders. The Home Office recommends a certified IDSP and employers remain liable for the check, according to guidance summarised by the REC and Lewis Silkin.
- **Umbrella companies:** from 6 April 2026, changes to ITEPA 2003 make agencies, or end clients where there is no agency, jointly and severally liable for PAYE and NICs an umbrella company fails to pay, according to the REC and Deloitte. Supply chain checks and records are now a financial control, not a nice to have.
- **Off-payroll working (IR35):** status determination statements for contractors placed with medium and large clients.
- **Enforcement:** the Fair Work Agency, a Department for Business and Trade executive agency, brings together employment rights enforcement including agency standards.
- **UK GDPR:** candidate retention periods and subject access requests.
